No. The state cannot dictate people allowing a squirrel to reside on their estate. Squirrels are wild animals, very prevalent in any wooded area. Most of New York was heavily forested during settlement, so the squirrels are everywhere. Since they can't stop them from living in your tree, and thus your roof (since many trees allow access to your roof), they cannot reasonably restrict you from allowing it into your home.
Of course, why would they? Squirrels are cute.Is it legal to have a squirrel as a pet in NY state?
